2. Account Registration and Eligibility

Eligibility

• You must be at least 13 years old to use SongSmartAI
• If you are under 18, you must have parental or guardian consent
• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials

Account Responsibility

You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other security breach.

3. User Responsibilities and Acceptable Use

You Agree Not To:

• Upload content that violates copyright, trademark, or other intellectual property rights
• Upload malicious software, viruses, or harmful code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the platform for any illegal or unauthorized purpose
• Abuse, harass, threaten, or intimidate other users
• Scrape, crawl, or automatically extract data from our platform
• Reverse engineer, decompile, or disassemble any part of our service
• Use our platform to distribute spam or unsolicited messages
• Interfere with or disrupt the integrity or performance of the platform
• Create multiple accounts to circumvent trial or subscription limitations

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

4. Intellectual Property Rights

Your Content

• Ownership: You retain all ownership rights to the sheet music PDFs and content you upload
• License to Us: By uploading content, you grant SongSmartAI a limited license to store, process, and display your content solely for the purpose of providing our services
• AI Processing: You grant us permission to send your PDFs to Google Gemini API for automated processing and metadata extraction
• Your Responsibility: You represent and warrant that you have the right to upload and share all content you submit to our platform

Our Platform

SongSmartAI and its original content, features, and functionality are owned by SongSmartAI and are protected by international copyright, trademark, and other intellectual property laws.

5. Subscription and Billing

Free Trial

• New users receive a 7-day free trial to test the platform
• No payment information is required during the trial period
• You can cancel at any time during the trial without being charged
• After the trial expires, access to premium features will be restricted

Paid Subscriptions

• Billing Cycle: Subscriptions are billed monthly or annually based on your selected plan
• Payment Processing: All payments are processed securely through Stripe
• Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date
• Price Changes: We reserve the right to modify subscription prices with 30 days' notice to existing subscribers
• Refunds: Subscription fees are non-refundable except as required by law or at our sole discretion

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you will retain access until that date.

6. Service Availability and Modifications

Availability

We strive to provide reliable and continuous service, but we do not guarantee that:

• The platform will be available without interruption
• All features will function error-free at all times
• The service will be available in all geographic regions
• AI processing results will be 100% accurate

Modifications

We reserve the right to modify, suspend, or discontinue any part of our service at any time. We will make reasonable efforts to notify users of significant changes.

7. Data and Privacy

Your use of SongSmartAI is subject to our Privacy Policy, which explains how we collect, use, and protect your information. By using our service, you consent to the practices described in our Privacy Policy.

8. Third-Party Services

Our platform integrates with third-party services including:

• Google Gemini AI: For PDF processing and metadata extraction
• Stripe: For payment processing
• AWS SES: For transactional email delivery
• Google OAuth: For authentication

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• SongSmartAI is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not responsible for loss of data, profits, revenue, or business opportunities
• We are not liable for AI processing errors or inaccuracies in extracted metadata

10. Indemnification

You agree to indemnify, defend, and hold harmless SongSmartAI and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of any rights of another party
• Content you upload or share through our platform

11. Account Termination

Termination by You

You may delete your account at any time through your account settings. Upon deletion:

• Your access to the platform will be immediately revoked
• Your uploaded files will be permanently deleted within 30 days
• Your account information will be removed from our active systems

Termination by Us

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service
• Your account is inactive for an extended period
• We are required to do so by law
• Your use poses a security or legal risk

12. Dispute Resolution and Governing Law
